Terms and conditions
The following terms and conditions apply to all website design and development offered by Smp designs.
By accepting a quote either verbally or in writing you are agreeing to the following terms and conditions.
- Quotes are valid for 28 days.
- It is the clients responsibility to check and ensure that any website is lawful and does not infringe any copyright or any other laws.
- At the project's acceptance Smp designs can provide an estimated completion date, however Smp designs cannot guarantee this date as a final completion date.
- A non refundable deposit of no less than 30% of the total quoted price must be provided before project commencement.
- If at any stage of development the client decides to cancel the agreement, then the client will lose there non refundable deposit. This in effect covers any work carried out to that point by Smp designs. The copyright of all work carried out up to this point will remain with Smp designs, apart from any images, animation, video or text that the client has supplied.
- If an agreement is cancelled then all materials delivered to the client to date in connection with that specific project must be returned.
- The use of copyright work by a client, in connection with a cancelled project without consent from Smp designs, could result in legal action.
- Once a project has commenced it will be completed using the information, data, text and images provided either by Smp designs or the client. Once the design process has been completed the project will be presented to the client who may make any changes to design and content as he wishes.
- Any additional work carried out, which is not outlined in the original quote, will incur extra charges. The client will be notified either verbally or written of these charges before the additional work commences.
- The copyright for all material provided by Smp designs, such as source code, graphics, photographs video, animation and text, will remain the property of Smp designs until such time as payment has been made in full whereupon they will become the property of the client.
- The client is ultimately responsible for checking the correctness of the site before they give Smp designs the go ahead to make the site publicly available.
- When a client agrees that a site can be made publicly available they are agreeing that the design and development of the site has satisfied all their requirements.
- A clients site will be hosted once approval of the design and content is given, however Smp designs reserve the right to remove the site at any time until the invoice is paid in full by one calendar month.
